Online issuing of the Regulation Certificates for Cash Benefits to Insured Person
Vide Notification No. N-21011/4/2022-BFT-II, it is directed that w.e.f. 1st August 2022 no regulation certificate for any cash benefit will be issued by the ESIC/ESIS dispensaries in physical form. Circular Regarding Non-Payment of ESI Contribution by the Employers
Based on the various complaints received from workers regarding non - payment of ESI contribution by the employer concerned, ESIC once again highlighted the following points for the compliance by all employers covered under ESI Act, 1948 – (a) An employer is to cover all employees including temporary/contract employees engaged through contractors or migrant labours, (b) It is duty of the principal employers engaging the contractor to ensure compliance under the ESI Act, 1948. The obligation arising out of the above cannot be avoided by the principal employer even when the immediate employer is having a separate ESI Code number for ease of compliance. Special Economic Zones (Third Amendment) Rules, 2022.
The department of commerce from the Ministry of Commerce and Industry, in a notification dated 14th July, made amendments to the Special Economic Zones (SEZ) Rules, 2006. A unit operating in the SEZ may now permit 50% of the employees, including contractual staff, to work from home or any place outside the SEZ. A new rule- 43A (work from home) is added to the SEZ rule book by the Ministry of Commerce and Industry. The categories of employees (including contractual workers) who will be permitted to work from home are listed in the new rule book. These individuals include those working in IT and ITeS SEZ units, those temporarily unable to work, those travelling, and those working remotely. No Additional Charges for issuing boarding passes at Airlines Counters
The Ministry of Civil Aviation has come to notice that Airlines are charging additional amount for issuing boarding passes from the passengers seeking check-in at the airport counters. Such additional amount is not as per extant provisions of Aircraft Rules, 1937. Therefore, the Ministry of Civil Aviation has advised the Airlines not to charge any additional amount for issuing boarding passes at the airport check-in counters, as the same cannot be considered within the ‘tariff’ as provided under rule135 of the Aircraft Rules,1937. Central – ESIC has Relaxed Conditions Under COVID 19 Relief Scheme
Vide notification No. N-12/13/01/2019-P&D, ESIC has relaxed the eligibility condition for providing relief under the Covid-19 relief scheme, which should have been paid or payable during a maximum period of one year immediately preceding the diagnosis of COVID-19 disease resulting in death. Maharashtra – State Government Removes all COVID 19 Restrictions
The Maharashtra government on Thursday decided to withdraw all Covid 19 restrictions imposed under the Disaster Management Act and Epidemic Diseases Act in the state from 0000 hrs of 1st April 2022. Therefore, following decisions are promulgated and conveyed to all – (a) All such orders that are currently in force for the imposition of restrictions related to COVID 19 that have been imposed under the Disaster Management Act, 2005 are hereby withdrawn and will no longer in force from 0000 hrs of 1st April 2022, (b) All district disaster management Authorities are also advised to withdraw all the restrictions regarding COVID 19. Vide notification No. XXIV of 2022, the Maharashtra Government has introduced The Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) (Amendment) Act, 2022. According to the amendment, (a) The name board of every establishment shall be in Marathi language in Devanagari script for the establishments employing ten or more workers or less than ten workers (b) The Marathi language shall essentially be written in the beginning of name board and the font size of the letters in Marathi Language shall not be smaller than the font size of the letters in any other language (c) The requirement towards Aadhaar card number in identity card to worker has been removed. Amendments Under the Andhra Pradesh Factories Rules, 1950
Vide notification no. G.O.Ms.No.7, the Andhra Pradesh Government has amended The Andhra Pradesh Factories Rules, 1950 to reduce compliance burden. According to the amendment, (a) The installed power required for approval of a factory plan shall be thirty horsepower or more instead of seventy-five horsepower or more, (b) Occupier of a factory must make an online application through single desk portal together with particulars, plans and scrutiny fee paid (c) The term for communicating approval plan is seven days from the date on which application has been submitted through online, (d) The drinking water shall be certified by NABL accredited laboratories, (e) The accounts pertaining to income and expenditure shall be submitted to canteen managing committee, (f) workers employed in raw cashew roasting shall be re-examined by a certifying agent once in every twelve calendar month, (g) The manager of every factory shall submit integrated annual return online through single desk portal on or before 30th April of the year. The Employees State Insurance (Central) Amendment Rules, 2022
Vide notification no.G.S.R. 176 (E), ESIC has amended provision on sickness benefit under The Employees’ State Insurance (Central) Rules, 1950. As per amendment, insured women who is receiving maternity benefit can also claim sickness benefit i.e., cash benefit in case shorter contribution period is available to her subject to condition that contribution shall be payable for not less than half the number of days available for working in such contribution period. Therefore, amendment entitle more insured women to claim the benefit and this retrospective amendment shall not prejudicially affect any beneficiary of any other benefit entitled under Employees’ State Insurance Act, 1948. Punjab - Exemption to Conditions for Women Employee Under The Shops and Commercial Establishment Act, 1958
Vide notification No. Labour-Lab0PSCA/2/2021-5L/I/325484/2022 and supersession of notification dated 15th October, 2014, The Governor of Punjab is pleased to formulate a scheme for the Shops and Establishments in the state under The Punjab Shops and Commercial Establishment Act 1958. According to the scheme, exemption given to the provisions towards conditions of employment for women and exemption will be given on case-to-case basis on receipt of applications from the establishments on the mentioned terms and conditions. Maharashtra – State Government Eases Restrictions on Covid 19
Vide Notification No. DMU/2020/CR. 92/DisM-1, State Executive Committee has decided to differentiate in response to the Covid 19 situation through restrictions or relaxations .The State Executive Committee promulgates the following directions, that will come into force from, 4rd March, 2022 from 0000 hrs across the State and will remain in force till the issue of any new order – (A) Municipal Corporations shall be dealt as separate Administrative Units and rest of the districts shall be dealt as single separate Administrative Units where the first dose vaccination is more than 90%, (B) All staff of all the establishments that cater to public at large shall necessarily be fully vaccinated, (C) Offline classes may resume in all academic institutions, (D) All shopping complexes, cinema halls, restaurants & bars, religious places, tourist places, entertainment parks etc. are allowed to operate with 100% capacity in Administrative Units, (E) There shall be no restrictions for inter-state and intra-state movement for fully vaccinated persons, (F) All offices, including government and private, may function with full capacity. SEBI/LAD-NRO/GN/2022/66 dated January 24, 2022, it has been decided that listed companies shall henceforth issue the securities in dematerialized form only while processing the following service request – (a) Issue of duplicate securities certificate, (b) Claim from Unclaimed Suspense Account, (c) Renewal / Exchange of securities certificate (d) Endorsement, (e) Sub-division / Splitting of securities certificate, (f) Consolidation of securities certificates/folios, (g) Transmission, (h) Transposition. The securities holder/claimant shall submit duly filled up Form ISR-4(to be hosted on the website of the Issuer Companies and the RTAs) along with the documents / details specified therein. Change in control of the asset management company involving scheme of arrangement under Companies Act, 2013
SEBI has decided the following to streamline the process of providing approval to the proposed change in control of an AMC involving scheme of arrangement which needs sanction of National Company Law Tribunal (“NCLT”):
(a) The application seeking approval for the proposed change in control of the AMC under Regulation 22(e) of MF Regulations shall be filed with SEBI prior to filing the application with the NCLT,( b) Upon being satisfied with compliance of the applicable regulatory requirements, an in-principle approval will be granted by SEBI, (c) The validity of such in-principle approval shall be three months from the date of issuance, within which the relevant application shall be made to NCLT.This circular shall be applicable to applications filed with NCLT on or after March 1, 2022. Maharashtra - Lockdown imposes from 10th January
In order to prevent the spreading of the Covid virus, vide Notification No. DMU/2020/CR. 92/DisM - 1, the Government of Maharashtra hereby issues the following directions that will come into force from 10th January, 2022 from 0000 hrs and shall remain in force till issue of any new Order – (a) A night curfew will be imposed from Monday barring movement of people in groups of 5 or more from 11 pm to 5am. Further, no movement will be allowed in public from 11 pm to 5 am except for essential services (hospitals, pharmacies, groceries, public transport, e commerce, Banks etc), (b) Schools and colleges will be closed till February 15 except for activities required to be undertaken for class 10 and 12 students and administrative activities of teachers (c) No visitors will be allowed at government offices except with written permission of office heads. Online interaction facility will be provided for people through video conference, (d) Government offices as well as Private offices have also been asked to rationalise the number of employees coming to work by allowing work from home and staggering working hours, (e) Public and political gathering will be capped at 50 and hotel, cinema halls to be operate at 50% seating capacity till 10 pm. Application of ESI Act to Banks
Vide notification, Central Government has declared that only the casual and contract employees of Non-Banking Financial Companies (NBFCs) and other establishments specified in the notification belonging to or under the control of Central Government are coverable under the ESI Act and banks are not coverable. Extension of Atmanirbhar Bharat Rojgar Yojana
EPFO has extended the registration facility under Atmanirbhar Bharat Rojgar Yojana (ABRY) from 30th June 2021 to 31st March 2022 As per the scheme, (1) incentive shall be in the form of payment of employee and employer contribution which is twenty four percent of wages in respect of new employees employed in establishments having more than one thousand employees, (2) establishments registered with EPFO after 1st October 2020 shall get the benefits in respect of all new employees. Vide Notification, EPFO has requested to file digital signature Certificate/e-sign of the authorised Signatory/Signatures only under the seal signature of the “Employer” along with a scanned copy of the Return of Ownership in Form 5A signed by the employer, failing which the signature of anybody else not duly authorized by the employer of the Establishment shall not be accepted as authorized. Vide Notification, the Government of Telangana has amended some rules on child labour. These Rules may be called the Telangana Child Labour (Prohibition and Regulation) (Amendment) Rules, 2021.They shall come into force on the date of their publication in the Telangana Gazette. According to the notification-(a) State government seeks to take strict action against those who employ or force children to work,(b) Labour Department will also constitute a task force committee headed by District Collector concerned, to effectively monitor and curb the child labour menace, (c) As per revised guidelines, film director will require to obtain permission from the Collector concerned in order to rope in children in movies or serials, (d) If parents force children to work, they will also face action, (e) If any child fails to attend school for 30 days, without permission, school principal will require to bring it to the notice of concerned nodal officer. The Assam Professions, Trades, Callings and Employments Taxation (Amendment) Act, 2021
Vide notification No. LGL.55/2005/46, the Assam Government has amended the provisions towards liability of tax, returns and included new provisions towards applicability of the provisions on Assam Value Added Tax and automated data processing system. Central - Circular Towards Linking of ESIC of Insured Person with EPFO
Vide circular, ESIC has decided to link ESIC insurance number of insured person with the EPFO's Universal Account Number (UAN), a twelve digit identification number allotted by EPFO. Therefore, members of EPFO with authorised Aadhaar and Bank details seeded against the UAN can submit their provident fund withdrawal or settlement or transfer requests. An arrangement has been made in the ESI portal where the employer can enter the UAN of IPs through the module. Once after entering details in the system the same can be verified with EPFO. Judgement of Honorable Supreme Court on ESI Contribution to Exclude Conveyance Allowance
Vide circular No. T-11/13/56/02/2020 Rev.II, ESIC has acknowledged to all regional and sub regional offices regarding judgement of the Hon'ble Supreme Court of India that payment of conveyance allowance as per present case does not fall under definition of term "wages" which means "all remuneration paid or payable in cash to an employee, if the terms of the contract of employment, express or implied, were fulfilled and includes [any payment to an employee in respect of any period of authorised leave, lock-out, strike which is not illegal or layoff and] other additional remuneration, if any, (paid at intervals not exceeding two months), but does not include (a) any contribution paid by the employer to any pension fund or provident fund, or under this Act ; (b) any travelling allowance or the value of any travelling concession ; (c) any sum paid to the person employed to defray special expenses entailed on him by the nature of his employment ; or (d) any gratuity payable on discharge" . Amendments to the Tamil Nadu Factories Rules

Governor of Tamil Nadu has amended Schedule XX towards handling and
processing of asbestos, manufacture of any article of asbestos and any other
process of manufacture or otherwise in which asbestos is used in any form. According
to the amendment - (a) Schedule shall apply to all manufacturing process
carried on in a factory involving exposure of workers to asbestos and/or
product containing Asbestos, (b) It apply to all workers exposed to asbestos in
the factory and it shall be the responsibility of the occupier of the factory
to comply with the provisions of this schedule in respect of the workers, (c)
The occupier of the factory wherein asbestos or substances containing asbestos
are in use, shall prepare work procedures and practices, in the light of

The Code on Wages (Telangana State) Rules, 2021
The
Government of Telangana, after careful examination of the matter, hereby
decided to issue draft rules namely the Code on Wages (Telangana State) Rules,
2021, which the State Government proposes to make, in exercise of the powers
conferred under section 67 of the Code on Wages, 2019 (Central Act No.29 of
2019) read with section 24 of the General Clauses Act, 1987 (Central Act No.10
of 1987) by inviting objections and suggestions from general public and
stakeholders in the matter. The said draft notification will be taken into
consideration after the expiry of a period of forty-five days from the date on
which the copies of the Official Gazette in which this notification is
published are made available to the public. The
objections and suggestions, if any, should be addressed to the Commissioner of
Labour, T. Anjaiah Bhavan, RTC ‘X’ Roads, Hyderabad, Telangana by post or
through email: col.labour.telangana@gmail.com & jcl.ts.hq@gmail.com. Objections
and suggestions, which may be received from any person with respect to the said

In order to facilitate the food businesses in retaining the existing License/Registration number, even if they change the location of food unit, FSSAI vide order no. 15(31 )2020/FoSCoS/RCD/FSSAI, dated 31st May, 2021, enabled Food businesses to migrate from State License to Central License or vice versa without change in the FSSAI License number. At the time of applying modification for change in jurisdiction, an automatic online application for transfer to be sent to existing authority, which needs to be scrutinized within 15 days of receiving of application. No comments on the transfer application by existing authority within 15 days would result in auto-approval. Then the application shall move to destined licensing/registering authority who shall scrutinize the same. Once approved, the license with its record/history shall shift to destined licensing authority. The Plastic Waste Management (Amendment) Rules, 2021
The Ministry of Environment, Forest and Climate Change, has notified the Plastic Waste Management Amendment Rules, 2021, which prohibits identified single use plastic items which have low utility and high littering potential by 2022. The manufacture, import, stocking, distribution, sale and use of following single-use plastic, including polystyrene and expanded polystyrene, commodities shall be prohibited with effect from the 01.07.2022- (a) ear buds with plastic sticks, plastic sticks for balloons, plastic flags, candy sticks, ice-cream sticks, polystyrene [Thermocol] for decoration; (b) plates, cups, glasses, cutlery such as forks, spoons, knives, straw, trays, wrapping or packing films around sweet boxes, invitation cards, and cigarette packets, plastic or PVC banners less than 100 micron, stirrers. In order to stop littering due to light weight plastic carry bags, with effect from 30.09.2021, the thickness of plastic carry bags has been increased from 50 microns to 75 microns and to 120 microns with effect from the 31st December, 2022.
Tamil Nadu Labour Welfare Fund (Amendment) Act, 2021

Currently the Act defines that Every employee shall contribute a sum not exceeding fifty rupees per year, as may be prescribed, from time to time to the Fund and every employer shall, in respect of each such employee, contribute a sum not exceeding hundred rupees per year, as may be prescribed, from time to time, to the Fund and the Government shall, in respect of each such employee, contribute a sum not exceeding fifty rupees per year, as may be prescribed, from time to time, to the Fund. ESIC - Extension of provision to Certain Establishments And Local Bodies In Manipur
Vide notification No.LAB-1/3/2020-LAB and EM-LAB&EMP, the Government of Manipur has extended the provisions of The Employees’ State Insurance Act, 1948 (ESIC) to the classes of establishments situated within the areas as specified in consultation with the Employees State Insurance Corporation and with the approval of the Central Government. Vide Notification No.DES/859/2021-P3(1), the Labour and Skills (E) Department of Kerala Government has revised the variable dearness allowance for employment in Shops and Commercial Establishment and employment in Computer Software Sector. West Bengal - Guidelines for Payment of Bonus or Ex-gratia To the Employees
Vide notification No. Labr/1690(LC-IR)/22013/56/2019, The Governor Of West Bengal makes an appeal to all employers and employees of the state covered under payment of Bonus Act,1965 as amended by the payment of Bonus (Amendment) Act, 2015 to stick to the following guidelines while setting the legitimate dues of workers in respect of payment of bonus, in view of ensuing Durga Puja, for the year 2021 – (a) Employers shall adopt a flexible attitude on the issue of payment of bonus,(b) Employers shall consider payment of an amount of ex-gratia in lieu of bonus as is admissible at the maximum stage workmen and employees who have crossed the eligibility limit, (3) All employees, whether in casual employment or re-employed after retirement or employed through contractors worked for not less than 30 days during the year should be paid bonus, (4) The employers who are in default towards payment of bonus for the previous years are also being requested to make such payments this year along with the payment of bonus, (5) All trade unions, and employers organizations shall extend their co-operation in maintenance of a climate of industrial peace and exercise their good offices for peaceful and effective settlement of industrial disputes, (6) Employees of IT sector, Hotels and Restaurants, Shops & Establishments, Security Workers and some workers in jute mills should get, (7) The payments of bonus should be made before commencement of Durga Puja, 2021, (8) All employers including the public sector undertakings will act according to this appeal, (9) Government also expects that all employers' organizations will advise their constituents to act according to this appeal. EPFO - Extension Of Timeline For Mandatory Seeding Of Aadhar Number
Vide circular No:
BKG-27/5/2021-BKG/, EPFO has extended the time till 31st December 2021
towards seeding of Aadhaar for EPFO administrative zone of north east region
comprising state of Assam, Arunachal Pradesh, Manipur, Meghalaya, Mizoram,
Nagaland and Tripura and establishments in remote localities, areas affected by
insurgency, frequent change of work site of workers, other attendant
constraints in classes establishments such as Beedi making, building and
construction and plantation industries. The delay in filing ECR for wage month
August 2021, September 2021, due to non-seeding of Aadhaar in establishments
located other than those areas as mentioned shall not be considered as
employer's default. Therefore, zonal offices are directed that regional offices
and district offices facilitate and coordinate with UIDAI to organize camps for
Aadhaar enrolment and correction in Aadhaar data of EPF member to facilitate
Aadhaar seeding in UANs and monitor the progress on weekly basis. Please

EPFO - Relief from Penalty for Delay in Deposit of Dues or Filing of ECRs

C-I/MISC./Pandemic Relief/2021/Vol-I, EPFO has directed its field
offices not to presume Employer’s default with respect to the delay in filing
of ECRs for the month of May, 2021 which are statutorily due on or before 15th
June 2021 on account of non-seeding of Aadhar with the UANs. Further, EPFO has
advised its offices to appreciate each case in its own facts under section 14B

Phased Programme for Implementation of ESI Scheme for year 2021-22.
The district wise phased programme of implementation of ESI Scheme for the year 2020-21 was conveyed as per vision - 2022. The target for 2020-21 could not be achieved due to non-completion of medical arrangement during the Covid pandemic. Now a new consolidated target for 2021-2022 is enclosed as Annexure-A with the request that necessary steps may be taken on priority for implementing the scheme in the districts shown in the annexure. In view of the above, the state government is requested to take steps to complete the medical arrangement in the districts for delivery of medical care to the insured persons and their family members so as to enable ESIC to take further action for issue of notification well in time for implementing the scheme. Maharashtra - Submission of Information on Accidents in Factories through Online
Vide notification no.24/2021, the Maharashtra Government has developed an online system to ensure timely receipt of information on accident in the factory. In case of fire, air leak, explosion or any other accident in factories, all manufacturers are advised to fill the details in Form No.24 or 24-A of the Accident Reporting System, which could be found on the Directorate's website i.e.www.mahadish.in and should be submitted with the signature of the Occupant/Manager of the Factory to the concerned office of the directorate within the prescribed time. EPFO - Guidelines for the Employers to rectify the details for KYC Update of Members
Vide circular, EPFO
has requested the Employers to follow the prescribed guidelines
subject to submission of correct proof of documents and records to enable the
member to update the KYC and to avail the benefit of online settlement and EPFO
services. In addition to this , it
has also been notified that complete change in the member profile cannot
allowed in the normal course through online or offline process except in extreme
situations wherein employer can prove that the member name has been changed
following the due process prescribed by law or if there has been erroneous
upload of member data by the employer following which the employer has to
produce documentary evidence of the member and after due verification, will be
considered for correction. The details of the requirement of certain documents
to be submitted by the Employer and the Member under various heads for
rectification of details for KYC update can be found on the attachment. Therefore,
Employer has been requested to notify their members who wish to rectify their
profile for KYC update for availing services and settlement under EPFO. Please

Delhi - Last day for applying DPCC Consent is 31st August,2021
All the industrial units operating in NCT of Delhi falls under the ambit of Air Act/Water Act and required to obtain DPCC Consent to establish and to operate under the provisions of Water Act, 1974 and the Air Act, 1981.DPCC now has being initiated to take action against units which have not obtained/registered DPCC Consent. The last date fixed for applying DPCC Consent is 31.08.2021 after which they will start strict action and may take coercive action against defaulter units. Amendment of working hours for Shops and Establishments in Karnataka
Vide notification No. E-LD 4 LET 2019 (p), the Karnataka Government has amended previous notification published on 2nd January 2021. According to the amendment, no employees in any establishment shall be required or allowed to work for more than nine hours on any day and forty-eight hours in any week and the total number of hours of work including overtime shall not exceed ten hours in any day, and the total number of overtime hours worked by an employee does not exceed fifty hours in a period of three continues months. ESIC COVID-19 RELIEF SCHEME
Vide notification No. N-12/13/1/2019-P&D, ESIC has introduced ESIC COVID-19 Relief Scheme as a welfare measure for the insured person who are employees of the ESI Act under which in case of death of IP due to Covid-19, the eligible dependent family members of IP will be paid periodic payments directly to their bank account. The scheme also provides eligibility conditions - (a) The deceased insured person must have been registered on the ESIC online portal at least 3 months prior to the death of diagnosis of COVID-19 disease. (b) The deceased insured person must be in employment in the date of diagnosis of COVID-19 disease and contribution for at least 70 days should have been paid or payable in respect of him or her during the period of maximum one year immediately preceding the diagnosis of COVID-19 diseases resulting in death. Amendments on The Madhya Pradesh Child Labour (Prohibition and Regulation) Rules,1993
Vide notification no.1036-183-2018-A-XVI, the Government of Madhya Pradesh has amended The Madhya Pradesh Child Labour (Prohibition and Regulation) Rules,1993. According to the amendment - (a) Inserted a new provision towards awareness on prohibition of employment of child and adolescents in contravention to Act, child to help his family without affecting education, child to work as an artist, payment of amount to child or adolescents for labour rehabilitation fund, person who are capable of filing complaints, provision towards compounding an offence, hours of work for an adolescent person, duties of magistrate and inspector, periodical inspection and monitoring, (b) New provision also include liability of producer for involving a child in audio-visual production or any commercial event and producer for such activity shall furnish Form C to the district magistrate for approval, (c) The previous rule must be replaced towards certificate of age and therefore- (i) Mandated that employer shall produce a certificate of age received from the appropriate medical authority to the Inspector on demand, (ii) The appropriate medical authority while examining an adolescents shall consider details such as Aadhar card, the date of birth certificate, birth certificate of adolescents given by a corporations or a Municipal Authority or a Panchayat, Please find the attached file for more detail information.

Under the Disaster Prevention act 2005, the State Management Committee of Maharashtra Government has issued revised guidelines by easing more curbs towards wellness, shopping and hospitality. According to these guidelines – (a) Local train travel is being allowed only to the health care officers / staff / essential service personnel as well as citizens who are fully vaccinated (b) Private offices and industries can open only with fully vaccinated staffs, (c) Shops will be open all days of the week till 10 pm, (d) Malls are also allowed to open all days throughout the week only with fully vaccinated staffs, (e) Restaurants, gyms, yoga center, salons, spas are also allowed to open all days of the week till 10 pm with 50% of their staffs, (f) Cinemas / theatres, multiplexes, all religious places will remain closed to the public till further orders. In EPFO, nominees are very important to get their share of PF accumulations/EDLI and the pension benefits in case of any calamity I.e., after the death of member. Based on member’s marital status, the nominees are also divided in two categories who are eligible for EPF/EDLI and Pension Schemes. At the time of making a nomination, if the member has no family, the nomination may be in favour of any person or persons but if the member subsequently acquires a family, such nomination shall forthwith be deemed to be invalid and the members shall make a fresh nomination. In order to avoid fraud in EPFO while settlement of claims & others,
the following advisory is being issued for guidance: -(a) Authorized signatory
details as provided by employer of all working establishment may be obtained if
the existing specimen signature is more than one year old, (b) Separate
password may be used for application software and FO interface, (c) Effort may
be made to advise member/employer to submit online claims instead of physical
claims and all physical claims must be verified with specimen signature, (d) Strict
action should be taken if any staffs (including outsourced staff) and official
is found using others user id and password,(e) EO area should be changed as per
HO guidelines. These are only an advisory from the government, RPFC-II/APFC must remain vigilant

Karnataka - Educational Assistance for Students under Labour Welfare Fund
Vide press note, Karnataka Labour Welfare Board has introduced educational assistance for the students who have passed in the previous examination with 50% for General category and 45% for SC/ST category and who are studying in the academic year 2021-2022 in the High School, (8th to 10th Standards) and PUC, ITI, D.ED, Diploma, Degree, post graduate, engineering and medical courses are eligible. The parents or guardian’s monthly income should not exceed rupees 21000/- per month and those who are paying contribution to the Karnataka Labour Welfare Fund are eligible to apply .Eligible students can apply through online from Labour Welfare Board Website www.klwbapps.karnataka.gov.in on or before 31.08.2021. As part of the Aatmanirbhar Bharat 3.0 package, the Central Govt. launched the Aatmanirbhar Bharat Rozgar Yojana (ABRY) to incentivize creation of new employment opportunities during the COVID-19 recovery phase by providing assistance to the employers of establishments registered with EPFO to recruit unemployed persons including re-employment of those who were rendered unemployed during the Pandemic. According to the amendment – (a) The fees towards application of competent person has been increased from ten thousand to twenty thousand,(b) Clause inserted towards approval by Chief Inspector for existing building/shed/structure/work of engineering construction, (c) The person issuing certificate of stability shall be a structural engineer registered under the provisions of the Goa Land Development and Building Construction Regulations, 2010, instead of competent person, (d) The application for registration and license shall be accompanied with fees as replaced, (e) The renewal of license shall be made through online mode, fees shall be paid through e-challan payment gateway,(f)The amendments also includes insertion of new rule towards arrangements of personal protective equipment. Kerala – The Minimum Wages Notification (May 2021)
Vide Notification No.DES/859/2021-P3(1), the Labour and Skills (E) Department of Kerala Government has revised the variable dearness allowance for employment in Shops and Commercial Establishment and employment in Computer Software Sector. According to the notification, the Consumer Price Index (Cost of Living Index) Numbers applicable to employees in employment under the Minimum Wages Act (Central Act XI of 1948) for the month of May 2021 ascertained by the Director General of Economics & Statistics under clause (C) of Section 2 of the Act. Delhi - Initiatives taken by GNCTD for complying various statutory provisions for the establishments

(30)/Lab/202I/93/7, the Labour Department, GNCTD has introduced a number of
initiatives to facilitate the establishments in complying various statutory
provisions relating to registration, license, permission and certificate by
introducing online and time bound services. As per the notification, the establishments
can maintain their mandated records and registers under existing labour laws in
electronic form also. The establishments may adopt a 'common display' for

ESIC - Measures for functionalization of Covid vaccination site at ESIC Hospitals for ESI beneficiaries.
In the current pandemic situation of Covid 19, Govt. of India is providing Covid vaccines to the States, which in turn are finalizing Covid vaccination sites. Under the current arrangement, Covid vaccination facility is not available at certain number of ESIC/ESIS hospitals and dispensaries. In this regard, the competent authority has taken some measures for functionalization of Covid vaccination site at ESIC/ESIS Hospitals/dispensaries/Special camps for ESI beneficiaries such as (a) All Regional Directors have been directed to coordinate with State Governments so as to ensure adequate allocation of Covid vaccines to ESI system, (b) ESIC/ESIS medical manpower Is to be optimally utilized for running Covid vaccination facilities so that ESI beneficiary are vaccinated in a hassle free and time bound manner. Hence, for the interest of IPs, the government has instructed all concerned to take requisite actions for smooth conduction of Covid vaccination services in ESI system. Madhya Pradesh – Circular on Special Campaign for License and Registration under Inter-State Migrant Workmen Enactment
The Madhya Pradesh Government has issued a circular to all jurisdictional officers in
Madhya Pradesh under The Inter-State Migrant Workmen (Regulation of Employment
and Conditions of Service) Act, 1979.According to the circular, all
jurisdictional officers has been directed by the labour department
to run a special campaign from 1st July 2021 to 31st July 2021. This
campaign will run for the registration of major employers and license to the
contractor and to make all the employers or institutions and labour
organizations of their jurisdiction aware of instructions as mentioned in the

I(List of Designated Trades) of The Apprenticeship Rules, 1992.These amended
rules may be called The Apprenticeship (Amendment) Rules, 2021 which shall come
into force on the date of their publication in the Official Gazette. According
to the amendment, the entries relating to Spinning Technician, Textile Wet
Processing Technician, Weaving Technician has been included under Group No.16
(Textile Trades Group) and Solar Technician (Electrical); Wind Power Plant
Technician (Electrical) has also been included under Group No.40 (Green Jobs

EPFO – Death Cases Presentation
Employees’ Provident Funds & Miscellaneous Provisions Act, 1952 provides three types of benefits to the employees of the establishment as well as their family members such as (a) Employees Provident Fund Scheme 1952,(b)Employees Pension Scheme 1995, and (c)Employees Deposit Linked Insurance Scheme 1976. The eligible person/persons to claim the PF/EPS/EDLI benefit must be the member of the family under the EPF Scheme. In order to claim these benefits, some documents are duly needed to be attached such as (a) Completely and duly signed claim forms, (b) Original Death Certificate, (c) Identity Document i.e. Aadhar of all claimants, (d) List of surviving members . All the employers are hereby instructed to check all particulars of deceased member are correctly updated on Unified Employer portal and all documents and forms are duly attested. Central Government – Certain Relief for the Taxpayers in order to ease the compliance burden
In view of the impact of the Covid-19 pandemic, taxpayers are facing inconvenience in meeting certain tax compliance and also in filing response to various notices. In order to ease the compliance burden of taxpayers during this difficult time, reliefs are being provided through Notifications nos. 74/2021 & 75/2021 dated 25th June, 2021 Circular no. 12/2021 dated 25th June, 2021. Certain taxpayers have lost their life due to Covid-19. Employers and well-wishers of such taxpayers had extended financial assistance to their family members so that they could cope with the difficulties arisen due to the sudden loss of the earning member of their family. In order to provide relief to the family members of such taxpayer, it has been decided to provide income-tax exemption to ex-gratia payment received by family members of a person from the employer of such person or from other person on the death of the person on account of Covid-19 during FY 2019-20 and subsequent years. The exemption shall be allowed without any limit for the amount received from the employer and the exemption shall be limited to Rs. 10 lakh in aggregate for the amount received from any other persons. The Tripura Code On Wages Rules, 2021
Vide Notification no. NO.F .21 (99-0 l )-LAB/ENF/CWR/202 l/ 904-906,the Government of Tripura has released Tripura Code on Wages Rules, 2021.These rules shall come into force after the date of their final publication in the Official Gazette, on the date of the commencement of the Code on Wages, 2019 (29 of 2019). The following draft rules, Which the State Government proposes to make, in exercise of the powers conferred by Section 67 of the Code On Wages, 2019 (29 of 2019) read with Section 24 of the General Clauses Act, 1897 (I0 of 1897) as is made applicable to the State of Tripura by the Tripura General Clauses Act, 1966 and in supersession of the:-
(i) The Tripura Minimum Wages Rules, l952;
(ii) The Tripura Payment of Wages (Procedure) Rules, l960;
made by the State Government in exercise of the powers conferred by the minimum wages Act, 1948 (l l of 1948), Payment of Wages Act; 1936 (4 of 1936), Payment. of Bonus Act, 1965 (2l of 1965) and Equal Remuneration Act, 1976 (25 of 1976) as the case may be, which are repealed by Section 69 of the Code on Wages, 2019, expect as respective things done or omitted to be done before such supersession, are hereby notified, as required by Sub-Section (I) of Section 67, for information of all ·persons likely to be affected thereby and notice is hereby given that the draft notification will be taken into consideration after the expiry of a period of forty-five days from the date on which the copies of the Official Gazette in which this notification is published are made available to the public. Delhi - Certain Relief for construction workers under BOCW (RE&CS) Act, 1996
Due to this current pandemic situation of Covid-19, the
construction workers in Delhi have faced lot of financial hardship during the
lockdown / curfew as all the construction activities in Delhi were stopped.
Therefore, vide notification no. F.No.17
(889)/DBOCWWB/2020/1275-1281, the Delhi Government under the Building
And Other Construction Workers (Regulation Of Employment And Conditions Of
Service) Act, 1996 has decided that annual contribution / late fees / penalty
if any for Registration / Renewal of construction workers shall be remain waive
off for next three months from date of issue of this notification. Further, the

ESIC - COVID-19 RELIEF SCHEME
Further to the notification on Covid 19 Relief Scheme, released on 3rd June, 2021, ESIC vide Notification no. CG-DL-E-18062021-227718 has released a new notification on 15th June, 2021. Haryana - Financial Assistance to the Dependent of Deceased workers
Vide circular no. No/DLCW/2021/459, Government of Haryana , Deputy Labour Commissioner (Welfare) of Gurugram has given instruction to all the establishments of Gurugram circle to provide Rs.2,15,000 as funeral expenses and financial help under labour welfare fund for the widows and dependents of deceased employees. The Mukhya Mantri Shramik Suraksha Yojna also provides Rs.5, 00,000 in the event of the death of an employee at workplace. Updation on e-Nomination Steps on EPFO Portal
As per the order issued by the Ministry and Labour Department, the employers are allowed to file the ECR only for the UANs seeded with Aadhaar; w.e.f. 01.06.2021. Therefore, in order to file the ECR, the Central Government has updated the steps for nomination on EPFO portal. The Tripura Shops and Establishments (Fifth Amendment) Act, 2021
In order to resolve and compliance with the purpose of Ease of Doing Business in the State, vide notification no. F.8 (3) Law/Leg-I/2021(P)/, the Tripura Government has introduced Tripura Shops And Establishments (Fifth Amendment) Act 2021 by repealing Tripura Shops And Establishments (Fifth Amendment) Ordinance 2021. According to the amendment, the existing provision of Registration of shops and establishments have been removed as there exists a parallel provision to obtain Trade License for pursuing business from the Competent local authority. Central – Proposal of Draft Code on Social Security (Employee’s Compensation) Rules, 2021
Vide notification no G.S.R. 385( E) , the Ministry of Labour and Employment has notified the draft Code On Social Security (Employee' s Compensation) (Central) Rules, 2021 for providing compensation to workers under the Code on Social Security, 2020. According to the notification, these draft rules will supersede the Employee’s Compensation Rules, 1924, the Employee’s Compensation (Transfer of Money) Rules,1935 and the Employee’s Compensation (Venue of Proceedings) Rules,1996 under the previous Employee’s Compensation Act, 1923. According to these new rules – (a) If the amount of compensation payable under sub-section (3) of section 77 is not paid by the employer within the period of 30 days, the employer shall pay, from the date on which the compensation become payable to the date on which it is paid, simple interest at the rate of 12% per annum or any other rate notified by the Central Government from time to time, (b) Money transmitted by one competent authority to another in accordance with sub-section (3) of section 92 shall be transmitted either by remittance receipt or by e-transfer or by net banking or by Demand Draft, as the competent authority transmitting the money may direct, (c) When the whole or any part of a lump sum deposited with a competent authority for payment as compensation under the Code is payable to any person or persons residing or about to reside in any other country, the competent authority may order the transfer to that country of the sum so payable, (d) Any part of the sum received from the transferring authority which shall have remained undisbursed after the completion of the proceedings shall be returned to the transferring authority by, or under the direction of the authorized officer. Central - Advisory to State Governments and UTs to Encourage Work from Home for Nursing Mothers
Vide a Press Release dated 1st June 2021, the Ministry of Labour and Employments has issued an advisory to all state government and union territories to encourage employers to allow work from home to nursing mothers wherever the nature of work so permits . It has been conveyed that employers may be advised to allow work-from-home, wherever nature of work so allows, for nursing mothers at least for a period of one year from the date of birth of the child. ESIC – Implementation of the COVID-19 Relief Scheme
In order to provide help to the families of the IPs who died due to COVID-19, ESIC, vide notification no. P-11/14/11/ COVID-19 Relief Scheme/2021-Bft- II , has approved the "ESIC COVID-19 Relief Scheme" where the dependent of insured person are entitled to receive 90% of the Average Daily Wages of the Insured persons during their life and will be paid periodically with certain terms and conditions.For the implementation of the scheme, ESIC has made certain rules – (a) The claimant for the relief will be required to submit their claim for relief under the scheme in form CRS-I enclosing the COVID-19 positive report and death certificate in nearest ESIC Branch Office, (b) Proof of the age and identity of defendants shall be given by means of Aadhar or birth certificate issued by the competent authority, (c) The power to decide the case shall be with the Regional Director/ Sub-regional office in charge as the case may be, (d) Medical Care will be provided to the widow of a deceased IP ,(e) All claims will be settled within 15 days of receipt of complete claim. Karnataka - Further Extension of Due Date for the Payment of Enrollment Tax

EPFO - Mandatory seeding of Aadhaar Number for filing of ECR
As per the order issued by the Ministry and Labour Department, the employers are allowed to file the ECR only for the UANs seeded with Aadhaar, w.e.f. 01.06.2021.To ensure that the members and the employers are not adversely affected in the transition phase, the following steps and measures may be undertaken by the field offices under the jurisdiction - (a) All the employers need to be made aware of the mandatory filing of ECR with Aadhaar validated UANs. Therefore, wide publicity may be ensured in this regard, (b) The ROs may conduct virtual conferences and also make use of the Social Media handles to reach out to maximum number of employers and subscribers, (c) A Nodal officer may be appointed, for coordination of these efforts and to facilitate the resolution of any issues being faced by the employers and members in this regard, (d) Daily progress may be obtained from the field offices, to ensure close monitoring. EPFO – Members have been allowed to avail second COVID-19 advance
During the second wave of Covid-19 pandemic, EPFO lends a
helping hand to its members by allowing them to avail second non-refundable
COVID-19 advance under Pradhan Mantri Garib Kalyan Yojana Scheme (PMGKY).
The
COVID-19 advance has been a great help to the EPF members during the pandemic,
especially for those having monthly wages of less than Rs. 15,000. Considering
urgent need of members for financial support in these trying times, it has been
decided to accord top priority to COVID-19 claims. EPFO is committed to settle
these claims within three days of their receipt. For this, EPFO has deployed a
system driven auto-claim settlement process in respect of all such members

Delhi – Development of a New Portal SPICE + for Registration of Establishments
Under Ease of doing business, a Single Window Facility has been developed by the Ministry of Corporate Affairs for incorporation of a new company and other different services including issuance of PAN, TAN, ESIC No, Bank Account, Professional Tax registration, GSTIN etc. on "SPICE+" portal. So, from now on 'SPICE+' portal will be integrated with Delhi Shops & Establishment registration portal and any company who wants to get registered themselves under the companies Act 2013 and is also taking first time registration under Delhi Shops & Registration Act, 1954 shall approach 'SPICE+ portal for the same. However, subsequent registration for different branch offices of the establishment under Delhi Shop & Establishment Act, 1954 can be taken directly on Delhi Shops & Establishment, registration portal i.e. https:/llabourcis.nic.ln. ESIC - Extension of Benefits for the Insured Person
The Ministry of Labour and Employment has announced additional benefits for workers through ESIC and EPFO schemes to address the fear and anxiety of workers about well-being of their family members due to increase in incidences of death due to COVID -19 pandemic. In order to support the families of Insured Persons (IP) under the ESIC scheme, the government has decided that the family members who have been registered in the online portal of the ESIC will receive the same benefits as received by the dependents of insured persons who die as a result of employment injury, subject to the following eligibility conditions- (a) The IP must have been registered on the ESIC online portal at least three months prior to the diagnosis of COVID disease resulting in death, (b) The IP must have been employed for wages and contributions for at least 78 days. The IPs, who fulfill the eligibility conditions, and have died due to COVID disease, their dependants will be entitled to receive monthly payment @90% of average daily wages of the insured person during their life. The scheme will be effective for a period of two years from 24.03.2020. A notification has been issued under the EPFO’s Employees’ Deposit Linked Insurance Scheme where some amendment has been made - (a) Amount of maximum benefit has been increased from 6 lakhs to 7 lakhs rupees, (b) Minimum assurance benefit of 2.5 lakh will be given to eligible family members of deceased employees, (c) Number of claims on account of death under the scheme has been estimated to be about 50,000 families per year. These kind of welfare measures taken by the Government will surely gives support to the families of workers who have died due to the COVID-19 disease and will protect them from financial hardships in these challenging times of pandemic. Maharashtra – Further Extension of Lockdown
Under the Disaster Management act 2005, for Containment of Covid 19 in the state, the Maharashtra Government finds it is necessary to impose various restrictions in different parts of the state beyond 7 AM on 1st June, 2021 till 15th June, 2021 to break the chain of transmission effectively. In the administrative units, where positivity rate is equal or less than 10%, following relaxations shall be applicable- (a) All essential shops that are currently allowed to operate between 7 am to 11 am may be allowed to operate between 7 am and 2 pm and in case of non essential shops, decision regarding the same may be taken by respective disaster management authorities, (b) Delivery of essential and non essential items through E commerce may be allowed in such districts,(c) Post 3 pm there shall be restriction on movements except for medical and other emergencies, (d) All government offices can function with 25% attendance. But in the administrative unit where the positivity rate is more than 20%, there the restrictions will be imposed vide ‘Break the Chain ‘ Orders dated 12th may, 2021 and the borders of such districts will be sealed and no influx or outflow of persons into or from districts will be allowed. Puducherry – Extension of lockdown
Vide notification no. 104/PSEC/COVID-19/2021, the Puducherry Government has enforced corona night curfew from 10.00 pm till 5 am up to 31st May 2021. According to the notification - (1) All public places, religious places, government offices will remain closed during these days, (2) Some essential services like Dairy & Milk supply, Pharmaceuticals, hospitals, banks, ATM's, electricity supply, water supply etc will remain open during these days, (3) Provision stores, groceries etc shall be permitted to function only from 5 am to 12 noon without AC, (4) Manufacturing units of Pharmaceuticals, Oxygen, medical equipment, automobiles, export units, shall be permitted to continue their work during these days under certain guidelines- (a) If a worker is found positive, other workers who have been in contact with the him will be quarantined with pay, (b) In any case, if a worker is found positive, the unit should be closed until completely sanitized, (c) If a worker is found positive, he/she would be allowed medical leave and cannot be discontinued during their absence for this reason,(d) Common toilet facilities must be sanitized frequently. Central - PF circular for Employers
The ministry of labour and employment has made an announcement for the employers. As per the announcement, with the coming into force of the Section 142 of the Code on Social Security, 2020, the ECR shall be allowed to be filed only for those members, whose Aadhaar numbers are seeded and verified with the UANs, w.e.f 01.06.2021. Therefore, in order to avail uninterrupted services of the EPFO and to avoid any inconvenience, it is requested to ensure the Aadhaar seeding in respect of all the contributory members. Due to the pandemic situation of Covid 19, vide notification no
No.VIII-1/21-91(Labour)/2008-TC-II(2) , the Uttarakhand Government has
exempted provisions of Section 51 (Weekly Hour), Section 54 (Daily Hour),
Section 55 (Intervals For Rest), Section 56 (Spread over Hours) for factories
relating to essential commodities and pharmaceutical manufacturers in
Uttarakhand subject to aforementioned conditions-(a) In all the above mentioned
industries , work can be done in two shifts of 12 to 12 hours per day
for a production unit in which per day 4 hours of overtime shall be paid
according to the rules,(b) Workers working in both these units can work
maximum 6 days in a week, and the limit of overtime will be 24
hours per week, (c) The extended working hours of the workers will be determined
in such a way that every worker will be given 30 minutes rest after 6
hours, (d) Employees shall not be laid off by the employer during this period ,
(e) The labour commissioner will ensure that the said emergency provisions are
not used by any factory continuously, (f) The value of this notification
will remain in effect for 60 days from the date of issue of the notification
and it will automatically ineffective after the said period. Please find the

Maharashtra - Extension of Working Hours for the Factories
Vide notification no 3620/1, the Maharashtra Government has exempted provisions of Section 51 (Weekly Hour), Section 52 (Weekly Holidays), Section 54 (Daily Hour), Section 56 (Spread over Hours) for factories in Maharashtra till 30th June 2021 subject to aforementioned conditions-(a) The working hours in a day should not exceed twelve hour,(b) Working hours on any day should not exceed thirteen hours including rest time,(c) The total working hour in any week should not exceed sixty hours,(d) It is the responsibility of the employer to ensure that changes in worker's working hour do not affect their safety with reference to chemicals or other hazardous factories,(e) Overtime pay should be paid at double the normal wage,(f) No workers should be given continuous overtime work for seven days in a row. Also, overtime hours in a quarter should not exceed one hundred fifteen hours,(g) The employer of the factory need to take all necessary precautions to prevent the spread of corona virus, (h) There should be a safe distance between the two workers during the manufacturing process in the factory and the use of the mask is mandatory always. Government of Telangana has issued some instructions regarding Facilitation of Registration and Renewal under the Telangana Shops & Establishments Act,1988 as part of Ease of Doing Business in the state. According to the instruction-(a)The requirement of inspection prior to registration is dispensed with,(b) Within 24 business hours, provisional registration certificate has to be issued. As the inspection prior to registration is dispensed with, the Commissioner of Labour, Telangana, Hyderabad is instructed that in order to further facilitate Registration under the Telangana Shops and Establishments Act, 1988, final order and issue of certificate of registration shall also be completed within 24 business hours from the time of online uploading of application for registration with other enclosures as may be prescribed. Delhi – Registration of all interstate migrant workers has now become mandatory.
Vide circular no.F.No.PA/Addl.LC/Lab/2021/499, the Government of Delhi has directed all employers who are employing their workers or have employed during last 12 months through outsourcing are required to mandatorily register with Labour Department through the e-district portal of Govt of NCT of Delhi on the link: https://edistrict.delhigovt.nic.in. The contractors have been instructed for issuing passbook to all interstate migrant workmen. According to the circular all the principal employers and contractors shall strictly follow the circular and non compliance of the following circular will attract legal action as mentioned in the Act. Central - Relief to establishments and factories from levy of penal damages for delay in deposit of dues during Lockdown
In view of the prolong lockdown announced by the Government to control the spread of COVID-19 pandemic and other disruptions due to Pandemic situation,the establishments covered under EPF & MP Act, 1952 are distressed and not able to function normally. Therefore, considering the difficulty faced by the establishments in timely deposit of contributions during the period of lockdown due to operational and economic reasons,any delay in payment of any contributions or administrative charges due for any period during the lockdown, no proceeding should be initiated by the Government for levy of penal damages in such cases. Telengana - Imposition of Lockdown from 12.05.2021 till 22.05.2021
In order to control the spread of COVID 19, Telengana Government issued an order for a complete lockdown in all parts of the state from 10.00 AM on 12.05.2021 to 6.00 AM on 22.05.2021. The lockdown restrictions shall not apply during the period from 6.00 AM to 10.00 AM. During the above mentioned period, the following regulations and measures shall be enforced: (a) Passenger vehicles shall be regulated on the State borders, (b) All public transport services will be permitted from 6.00 AM to 10.00 AM, only emergency medical services shall be permitted throughout the day,(c) All Inter-State bus and transport services shall stand suspended,(d) All Government, as well as private establishments shall make payments of wages / salaries fully to the workers / employees including those working under contract and outsourcing basis during the above period,(e) All religious places, Anganwadi Centers shall remain closed during the said period. Some of the following activities such as Medical services, Agriculture and related operations ,Cold storage and warehouses, Medical shops and pharmacies, production and distribution of power, supply of drinking water, Petrol pumps located on National Highways, Banks/ATMs, All security services, E-commerce, IT and ITeS, including telecom, postal and internet services shall be exempted from lockdown restrictions and will be permitted during the said period, subject to compliance with Covid appropriate behavior like social distancing, wearing of face mask and other Covid related protocols. Some of the departments of the State Government such as Health, Medical,Police,Fire,Electricity, water supply, Taxation, Agriculture etc shall be fully functional during these time period. Central Government - Provision for Setting up Of Technical Committees under Occupational Safety, Health and Working Conditions Code, 2020
Vide notification no. G.S.R. 261(E), The Central Government has notified ''Setting up of Technical Committee" under the Occupational Safety, Health and Working Conditions Code, 2020 for assisting the Central Government or the National Board in discharging Safety and other related measures across Industrial Establishments. This technical committee shall consist of members from government, public and autonomous or private institutions/industries and the members of the committee shall have Bachelor’s degree in engineering or Master’s Degree in (Physics/Chemistry) or MBBS with postgraduate in Medical Sciences or adequate experience of not less than 20 years in the specified field/ industry. The technical committee shall frame, formulate and review standards, rules and regulations under the Occupational Safety, Health and Working Conditions Code, 2020 and have further laid down provisions with respect to Resignation, Cessations, Disqualification and removal from membership. As a part of the pre-consultation process and in compliance with 134(1) of the Occupational Safety, Health and Working Conditions Code, 2020 i.e. condition of previous publications of Draft Rules under the Code, inviting Objection and suggestion, which may be received from any person or organization with respect to the draft notification before the expiry of forty-five days from the date of publications will be considered by the Central Government. Himachal Pradesh - Extension of Working Hours for the Factories
Vide notification no.Shram(A)4-3/2017,the Himachal Pradesh Government has exempted all factories registered under The Factories Act,1948 in the state from the provisions of Section 51 (Weekly Hour), Section 54 (Daily Hour), Section 55 (Interval Of Rest), Section 56 (Spread over) for a period of three months from the date of publication of the notification. According to the notification, (a) Twelve hours in a day and Seventy Two hours in a week will be the working hours for all adult workers in the factories (b) The period of working hours of adult workers in a factory will be fixed and no workers shall work for more than six hours before he had an interval for rest at least half an hour (c) Wages in respect of increased working hour as a result of this exemption shall be in proportion to the existing Minimum Wage fixed by the Government of Himachal Pradesh under Minimum Wage Act 1948 (d) Provision of the Over Time under section 59 of the Act shall continue to apply without any change. Central - Appointment Of Effective Date Of Section 142 of Code On Social Security, 2020
Vide notification no.1603, the Government of India has appointed the 3rd May, 2021 as the date on which the provisions of section 142 of the Code on Social Security, 2020 shall come into force. According to the notification, from 3rd may 21, Aadhaar has been made mandatory by the Government as identity proof for all employees and workers, including organized and unorganized workers, to avail social security benefits in order to prevent the misuse of the benefit being given to workers or employees with a fake identity. Section 142 of the Code on Social Security, 2020 provides that the employees or unorganized workers shall, to register as beneficiaries to avail social security benefits such as medical and sickness benefits, pension, gratuity, maternity benefit, or any other benefit or withdrawal of fund. The Aadhaar registration is mandatory for all workers and employees seeking social security benefits from the government in either kind or cash. Tamil Nadu - Amendment To The Factories Rules, 1950
Vide notification number SRO A-9/2021,certain amendments has been introduced to the Tamil Nadu factories rules 1950 by their State Government.According to the amendment under rule 103, regarding maintenance of muster roll and registers, the Manager of every factory is required to maintain a muster roll of all the workers employed in the factory in Form No. 25 and entries shall be made at the commencement of each period of work. The Manager shall make such muster roll readily available for inspection to the inspector at all times during working hours or when any work is being carried on in the factory and it shall be preserved for a period of three years after the last entry. Assam - Declaration Of Paid Holiday For Three Days On Account Of Legislative Assembly Election 2021
27th March 2021 (Saturday), 1st April 2021 (Thursday), 6th April 2021 (Tuesday) has been declared as a paid holiday by the Governor of Assam on account of the first phase, second phase, and third phase of the General Election to State Legislative Assembly, 2021. All Government and Non-Government Offices/PRIs/Urban Local Bodies/Educational Institutions and Business Establishments including Banks, Tea Garden and Industries within the specified jurisdiction shall remain closed on these three days on account of these public holidays. Rajasthan - Third Party Building And Other Construction Workers Establishment Inspection Scheme
Vide notification no F-8(1) EODB/IR/Shram/2020-PT-II ,a third party inspection scheme under the Building And Other Construction Workers (Regulation Of Employment And Conditions Of Service) Act, 1996 has been introduced by the Government of Rajasthan. According to the Scheme, any employer can apply online on the official RajFAB web application to get their establishment inspected by a third party and the employer can re-select for the scheme only if the compliance of the inspection is submitted online.
